cbd oil law in the USA - DEA clarifies [2019]

In this video, we go through the federal law in the US with regard to use, possession and supply of CBD oil - the federal law in all 50 states. CBD (Cannabidiol) is a major compound in Hemp/Marrijuana famed for it's potential medicinal benefit. But the legal status of CBD in the US is slightly shrouded in mystery. In recent months, a drug called Epidiolex was licensed in the US for rare forms of epilepsy. This drug contains purified CBD. Subsequently federal agencies, such as the DEA, were forced to review their position on CBD oil use for medicinal purposes. In this video i share excerpts from an interview given by a DEA spokesperson in which he clarified the position of the DEA. Is CBD Oil Legal? (50 States Guide)

While hemp was made legal at the federal level with the 2014 Farm Bill, the legality of CBD still stands in a confusing grey area in many states. https://www.hempurecbd.com/is-cbd-oil-legal-in-all-50-states/ We dug into the laws of each state and even hired a group of lawyers to help us understand the legal landscape. Here’s what you need to know. The legality depends on the source of the CBD. While hemp-derived CBD is legal in all 50 states, ‘marijuana’-derived CBD is not legal federally. The government classifies hemp as any plant of the cannabis family that contains less than 0.3% THC. It classifies “marijuana” as any plant of the cannabis family that contains greater than 0.3% THC. The hemp cannabis plant has a high amount of CBD and low THC, making them the most efficient plant for CBD processing. So the bottom line here is, if your CBD comes from hemp, it is legal. If it comes from “marijuana’, it’s only legal if your state legalized marijuana. States can be grouped into four jurisdictional categories. One, Friendliest States. These are jurisdictions in which there are explicit permissions for the retail sale of industrial hemp-derived products. These jurisdictions include Alaska, Colorado, Illinois, Indiana, Kentucky, Maryland, Missouri, New York, North Carolina, Oregon, Rhode Island, South Carolina, Tennessee, Utah, Vermont, and Wisconsin. Two, Friendly States. These are jurisdictions where industrial hemp grown in a Farm Bill-compliant agricultural pilot program is explicitly exempted from the definition of marijuana. These jurisdictions include the District of Columbia, Hawaii, Kansas, Montana, New Mexico, North Dakota, and Oklahoma. Three, Gray Area States. These are jurisdictions without explicit prohibitions against the retail sale of industrial hemp-derived CBD products but that have exemptions in the law for the argument that hemp-derived CBD products are legal. These jurisdictions include Arkansas, Delaware, Florida, Georgia, Idaho, Iowa, Louisiana, Maine, Massachusetts, Minnesota, Mississippi, New Hampshire, New Jersey, Pennsylvania, Texas, Virginia, and Washington. Four, States with Concern. These are jurisdictions in which, while there are no explicit prohibitions against the sale of industrial hemp-derived CBD products, but in which recent law enforcement actions or pronouncements raise the risk of the retail sale of industrial hemp-derived CBD products. These jurisdictions include Alabama, Arizona, California, Connecticut, Michigan, Nebraska, Nevada, Ohio, South Dakota, West Virginia, and Wyoming. Federal law permissions for activities involving industrial hemp are clear. However, the Farm Bill, and other federal laws on industrial hemp, do not preempt state law. Just as there are hundreds of municipalities in the United States that prohibit alcohol sales nearly a century after Prohibition’s repeal, local and state laws may still restrict the sale of industrial hemp products even where federal law is clearly permissive. With the increasing number of offshore oil and gas platforms on the continental shelf areas around the world, their regulation is becoming a new area of responsibility for some Customs administrations, while Customs administrations or other border agencies that already have responsibilities in the regulation of the offshore petroleum industry may find that they have to devote more time and resources to it. Eric Cantor (R-VA) visited the Chicago headquarters of the CME Group, "the world's largest owner and operator" of private exchanges for derivatives products. CME Group specializes in a number of markets, including trading futures contracts for various blends of crude oil and food commodities. Cantor met with executives, and at one point, gave brief remarks before CME Group employees and various commodity speculators. Cantor told the audience of speculators that his Republican caucus would "do our part" to block the implementation of financial reforms passed last year as part of the sweeping Dodd-Frank law. He even called out the Commodity Futures Trading Commission, the regulators in charge of overseeing derivatives and energy speculation, and promised to stop regulations from going online: Currently, energy speculation is at an all time record high. In 2008, according to many analysts, oil speculation — which took place on unregulated private exchanges owned by the CME Group and a set of international exchanges — spiked gas prices to unprecedented levels. Now, excessive oil speculation is again driving the pain at the pump. While Goldman Sachs has claimed that at least $25 of the current price of crude oil is due to speculation, financial experts contacted by ThinkProgress say the Goldman Sachs number is probably very conservative. Although the Dodd-Frank reforms passed last year included a new mandate for regulators to curb rampant oil speculation, these regulations have not yet been implemented. Republicans, under Cantor's leadership, are working furiously to ensure that they never will be. For instance, Cantor's caucus has proposed massive budget cuts to the Commodity Futures Trading Commission — the regulatory body charged with overseeing oil speculators at the CME Group. As the New York Times has reported, CFTC regulators literally do not have enough money even for staplers, and can barely enforce laws on the books before even getting to new Dodd-Frank rules. In addition, Republicans are also pushing a separate bill to delay Dodd-Frank derivatives reforms for at least eighteen months.

The Oil Pollution Act (OPA) was signed into law in August 1990, largely in response to rising public concern following the Exxon Valdez oil spill. The OPA improved the nation's ability to prevent and respond to oil spills by establishing provisions that expand the federal government's ability, and provide the money and resources necessary, to respond to oil spills. The OPA also created the national Oil Spill Liability Trust Fund, which is available to provide up to one billion dollars per spill incident. In addition, the OPA provided new requirements for contingency planning both by government and industry. The National Oil and Hazardous Substances Pollution Contingency Plan (NCP) has been expanded in a three-tiered approach: the Federal government is required to direct all public and private response efforts for certain types of spill events; Area Committees -- composed of federal, state, and local government officials -- must develop detailed, location-specific Area Contingency Plans; and owners or operators of vessels and certain facilities that pose a serious threat to the environment must prepare their own Facility Response Plans. Finally, the OPA increased penalties for regulatory noncompliance, broadened the response and enforcement authorities of the Federal government, and preserved State authority to establish law governing oil spill prevention and response. Jo Hiller reveals the marketing tricks of the energy corporations. He meets with physicians who criticize the distribution of medical misinformation. Laboratory analyses – commissioned by the German broadcaster NDR – prove that pollutants are released into the environment in the vicinity of the drilling sites. Autocrats like Putin and the Saudis spend oil money on weapons and repression. ISIS and Congo's militias spend resource money on atrocities and ammunition. For decades resource-fueled authoritarians and extremists have forced endless crises on the West - and the ultimate source of their resource money is us, paying at the petrol station and the mall. In this lecture, Leif Wenar will talk about his new book, Blood Oil, which goes behind the headlines in search of the hidden global rule that puts shoppers into business with the men of blood - and discovers an ancient law that once licensed the slave trade, apartheid and genocide. The abolition of this rule marked some of humanity's greatest triumphs - yet the rule zombies on in today's multi-trillion dollar resource trade, enriching tyrants, warlords and terrorists worldwide. By our own deepest principles, over half of the world's traded oil is stolen. Oil Pipeline Regulation Process “Not Working” Say Environmentalists

Sometimes you need to get arrested to be heard. Last month more than 250 people marched to Enbridge’s offices in Duluth to deliver a letter asking the oil company to delay expansion of its pipelines until full environmental impact statements had been completed. Enbridge staff refused to read the letter and called police, who arrested seven of the demonstrators for trespassing. On Tuesday, four of those arrested got a chance to tell the media what they wanted to tell Enbridge. “We’re here because we’ve been playing by the rules in this pipeline process for three years and it’s not working,” said Honor The Earth organizer Thane Maxwell. “The regulatory process of the state is profoundly dysfunctional. Enbridge’s own process is disrespectful and aggressive, dishonest and in violation of their own policy on consultation and relationships with native people.” The process for regulating an international pipeline is complicated and Honor The Earth and other environmental groups have been fighting it in court. This week Enbridge won a federal court victory that would let it increase crude oil shipments from Canada to the United States via two parallel pipelines it reconfigured at the border to skirt a regulated capacity limit on one of them. Environmentalists say the switch circumvented environmental review of the expansion project. The rulings came a day after a National Academies of Sciences study found the heavy bitumen crude oil from Canada poses an extra environmental risk. When spilled into waterways it soon turns into a thick, hard-to-recover residue that doesn’t degrade. One of the Enbridge lines being used to ship the crude across Minnesota operates at reduced volume because of its history of leaks. The letter Maxwell and other supporters brought to Enbridge had several specific requests for changes to the permitting process, including formal consultation with tribal governments (as required by Enbridge’s official Aboriginal and Native American policy), and postponement of all projects until full Environmental Impact Statements have been completed (as required by state and federal law). Most of all, they want to have a conversation with the company. Enbridge’s response, drums and round dance video In a prepared statement, Enbridge says it wants to have “conversations”, but asks that they be in an “appropriate forum,” which apparently their Duluth office was not. “So this action was our way of going to their space, to their office and saying what you’re doing is not OK,” Maxwell told the media before he and three others were arraigned on trespassing charges at the St. Louis County Courthouse. “They do not want to have a conversation. They do not want to engage with us. They want to make a profit,” said one of the demonstrators who had visited Enbridge. “The people who were arrested that day were non-native people,” said Maxwell. “This is a solidarity action, solidarity arrest. It’s non-native people standing up and saying treaties are our issue too. Our ancestors signed those agreements and we have a responsibility to uphold them.” The big picture Jesse Peterson was one of those arrested. He sees the struggle with Enbridge as part of a larger power clash between the profit-driven wealthy class and everyone else. “They’re thinking that a quest for profits makes more sense in giving just a few people the ability to hoard a wealth so powerful that they get to decide if you have jobs and food and shelter. They can make rules that hurt native folks, they hurt black folks, white folks that they don’t like. and there’s just too much power in too few hands. We need to have real conversations. Their laws prevent us from having real conversations. They’re immoral laws. They’re laws I don’t want and they’re laws I won’t behave with.” And please don’t call them protesters. “We’re not here protesting,” said Maxwell. “We’re here protecting the earth.” “This is the same process of colonialist violence that’s been going on for 500 years. Corporations, the government – they’re in it together.” “500 years is enough.”
